Introduction
Who can issue a Petition?
Either the husband or wife providing the issuing party has sufficient grounds.
What are the grounds for divorce?
The grounds on which a petition can be issued are:-
(a) Adultery
(b) Unreasonable behaviour
(c) Two year separation by consent
(d) Five year separation without consent
(e) Desertion
When can a Petition for divorce be issued?
A petition for divorce can be issued once the parties have been married for at least one year.
How long will it take?
This very much depends on the circumstances, but generally a straight forward undefended divorce with no disputed issues regarding finances or children will take approximately 3 months. This period includes the statutory 6 weeks and 1 day waiting period between Decree Nisi and Absolute.
How much will it cost?
Again this very much depends on the individual circumstances involved. Mrs Kebbell will provide details of how our fees are calculated and will give a best estimate of likely costs at the outset. All clients are given regular updates on information on costs as the matter progresses.
